SportsApp Affiliate Programme Terms and Conditions
Effective date: 21 October 2026
Website: https://sportsapp.co.za/
1. Agreement and acceptance
By applying to participate in the SportsApp Affiliate Programme (“Programme”), you agree to these Terms and Conditions (“Agreement”).
The Programme enables approved affiliates to promote products sold through the SportsApp online store and earn commissions on qualifying sales generated through their unique affiliate links.
SportsApp reserves the right to amend these Terms and Conditions from time to time. Where required by applicable law, SportsApp will provide appropriate notice of material changes. Continued participation after changes take effect constitutes acceptance of the revised terms to the extent permitted by law.
If you do not agree with these Terms and Conditions, you must not participate in the Programme.
Any breach of this Agreement may result in the suspension or termination of your affiliate account. Commissions may be withheld or forfeited only where permitted by applicable law and these Terms and Conditions, including where they arise from fraudulent or invalid transactions.
2. Definitions
For purposes of this Agreement:
SportsApp: The operator of the SportsApp online store at https://sportsapp.co.za/.
Affiliate: An individual or business approved to participate in the Programme.
Affiliate link: A unique tracking link assigned to an Affiliate.
Customer: A person or business purchasing products through the SportsApp website.
Qualifying sale: A completed, paid and eligible product sale correctly attributed to an Affiliate under the Programme’s tracking rules.
Commission: The amount payable to an Affiliate for qualifying sales, calculated according to the commission rates and rules communicated by SportsApp.
3. Affiliate account requirements
To participate in the Programme, you must:
Be at least 18 years old and legally capable of entering into a binding agreement.
Provide accurate and complete registration information.
Provide your full legal name or registered business name, a valid email address and any other information reasonably required for account verification and payment.
Maintain only one affiliate account per individual or legal entity, unless SportsApp has provided prior written approval for additional accounts.
Keep your login credentials confidential and take reasonable steps to protect your account.
Accept responsibility for activities conducted through your account, except where applicable law provides otherwise.
Notify SportsApp promptly if you suspect unauthorised access to your account.
Use the Programme only for lawful purposes and in accordance with these Terms and Conditions.
Automated registrations, fake identities, misleading account information and attempts to manipulate the Programme are prohibited.
Affiliates may participate from South Africa. Affiliates residing outside South Africa may be accepted at SportsApp’s discretion, subject to applicable laws, verification requirements and payment arrangements.
SportsApp may request additional documentation to verify an Affiliate’s identity, business registration or payment details.
4. Affiliate links, banners and promotional materials
Once your application has been approved, SportsApp will assign you a unique affiliate code or tracking link.
You may use approved SportsApp links, banners, logos and promotional materials on your website, social media pages, email communications and other permitted marketing channels.
You agree to:
Use affiliate links in the format provided or approved by SportsApp.
Ensure that links direct customers to the appropriate SportsApp website or product page.
Avoid altering tracking codes or using techniques that interfere with accurate referral tracking.
Use SportsApp’s name, logo and other intellectual property only as permitted by this Agreement.
Stop using outdated or withdrawn promotional materials when reasonably requested.
Avoid making false, misleading or unauthorised claims about SportsApp, its products, prices, stock availability, warranties or delivery arrangements.
SportsApp may update its promotional materials, banners, links and brand guidelines from time to time. Where a change materially affects existing promotional materials, SportsApp will provide reasonable notice where practicable.
Affiliate links must be clearly identifiable and must not be disguised in a way that misleads customers.
5. Affiliate disclosure and advertising standards
Affiliates must clearly and prominently disclose their financial relationship with SportsApp whenever they promote SportsApp products using affiliate links.
For example:
“I may earn a commission if you purchase through my affiliate link.”
The disclosure must be easy to notice and understand before or when the customer engages with the promotional content.
Affiliates must comply with applicable South African advertising, consumer protection, electronic communications and privacy laws, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, where applicable.
Affiliates must not:
Make false, deceptive or unsubstantiated product claims.
Advertise discounts or promotions that SportsApp has not authorised.
Send unsolicited bulk marketing messages unlawfully.
Impersonate SportsApp or imply that they are employees or authorised representatives.
Publish defamatory, unlawful or misleading content.
Use spam, deceptive redirects, cookie stuffing, fake clicks, automated purchases or other fraudulent traffic-generation techniques.
Bid on SportsApp-branded search terms or use SportsApp trademarks in paid advertising where SportsApp has prohibited that activity.
Offer unauthorised cashback, rewards, discounts or incentives in connection with affiliate links.
Affiliates are responsible for obtaining any permissions and consents required for their marketing activities.
6. Commission eligibility and tracking
A commission may be earned when a customer clicks a valid affiliate link, visits https://sportsapp.co.za/ and completes a qualifying purchase that is correctly attributed to the Affiliate by SportsApp’s tracking system.
Commission eligibility is subject to the following conditions:
The transaction must be recorded by the Programme’s tracking system.
The order must be successfully paid for and not fraudulent.
The sale must comply with the Programme rules and any applicable promotional conditions.
The order must not be cancelled, refunded, reversed or charged back.
The Affiliate must not have generated the sale through prohibited marketing practices.
SportsApp will use its tracking system to determine which Affiliate receives credit for a sale, in accordance with the Programme’s stated attribution rules.
SportsApp cannot guarantee that every referral will be tracked successfully, including where customers block cookies, change devices, clear browser data, use different browsers or fail to use the Affiliate’s link correctly.
Where a technical issue affects tracking, SportsApp may investigate the matter and make a reasonable determination based on the available records.
Commissions will not be payable on sales that cannot reasonably be verified as qualifying sales.
7. Commission rates and calculation
The commission rate applicable to the Programme will be communicated to Affiliates through the affiliate dashboard, Programme documentation or another written communication issued by SportsApp.
Unless otherwise expressly stated:
Commission will be calculated on the qualifying product sale amount, excluding delivery charges, refunded amounts, cancelled items and any other amounts expressly excluded from the Programme’s commission calculation rules.
Any applicable VAT treatment will be determined in accordance with South African tax law and the Affiliate’s tax status.
Commission rates may differ between products, categories or promotional campaigns where these differences have been communicated to Affiliates.
SportsApp will not retrospectively reduce commission already validly earned except where an adjustment is justified by a cancellation, refund, chargeback, calculation error, fraud or another lawful basis.
SportsApp may amend future commission rates by providing reasonable notice to Affiliates. Updated rates will apply from the effective date communicated by SportsApp.
Affiliates are responsible for checking their dashboards and Programme communications for current commission rates and eligibility requirements.
8. Payment threshold and payment schedule
All commissions will be calculated and paid in South African rand (ZAR), unless SportsApp agrees otherwise in writing.
The minimum payment threshold is R300 in accumulated eligible commissions, unless SportsApp communicates a different threshold in writing.
Subject to verification and the conditions below:
Payments will ordinarily be processed monthly.
An Affiliate whose eligible commission balance has reached the payment threshold will be considered for payment during the next payment cycle.
An Affiliate whose balance has not reached the threshold will have the eligible balance carried forward to the next payment period.
Payments will be made using a payment method approved by SportsApp, subject to the Affiliate supplying accurate payment details.
SportsApp may request identity verification, banking confirmation, tax information or other reasonably necessary documentation before processing payment.
Payment processing may take additional time where verification, banking procedures, weekends, public holidays or technical issues cause delays.
SportsApp will communicate any material change to the payment threshold or payment schedule before it takes effect.
The R300 threshold is an administrative payment threshold and does not, by itself, extinguish an Affiliate’s validly earned commission.
Upon termination of the Programme or an Affiliate account, SportsApp will reconcile the account and pay any verified, undisputed commission legally due, subject to reasonable verification, applicable deductions and the provisions of this Agreement.
9. Refunds, cancellations and chargebacks
If a customer cancels an order, receives a refund, disputes a transaction successfully or initiates a chargeback, the related commission may be reversed or adjusted.
SportsApp may also correct commission balances resulting from duplicate transactions, technical errors or demonstrably fraudulent activity.
Any adjustment must be reasonably related to the affected transaction and applied consistently with this Agreement and applicable South African law.
SportsApp will not automatically confiscate unrelated, validly earned commissions merely because another transaction is disputed.
10. Prohibited self-referrals and fraudulent activity
Affiliates may not use their own affiliate links to generate commissions on purchases made for their personal use or on behalf of a business they control, unless SportsApp has expressly authorised this in writing.
The following activities are prohibited:
Purchasing through affiliate links to generate commission for oneself.
Creating fictitious customers, orders or accounts.
Using bots or automated systems to generate clicks, referrals or purchases.
Manipulating tracking cookies, referral codes or attribution records.
Using stolen payment information or facilitating fraudulent transactions.
Encouraging customers to make purchases under false pretences.
Misrepresenting customer interest or artificially inflating referral traffic.
SportsApp may investigate suspected violations, suspend affected transactions and temporarily restrict account access where reasonably necessary.
Where fraud or a material breach is established, SportsApp may reverse affected commissions, suspend the account or terminate participation. Any withholding or forfeiture must be supported by the circumstances and permitted by applicable law.
11. Customer relationship and product information
Customers who purchase products from SportsApp remain customers of SportsApp.
SportsApp is responsible for managing its product catalogue, prices, stock availability, order processing, customer service, delivery arrangements, returns and refunds, subject to applicable law.
Affiliates must not promise a customer any price, discount, delivery date, return entitlement or product guarantee that SportsApp has not authorised.
Product prices, specifications and stock levels may change without notice. Affiliates should direct customers to the SportsApp website for current product information.
SportsApp will endeavour to maintain accurate website information but cannot guarantee that every listing will always be free from errors or that every product will remain available.
Nothing in this Agreement limits a customer’s rights under applicable South African consumer protection legislation.
12. Affiliate responsibilities
Each Affiliate is solely responsible for the development, operation and maintenance of their own website, social media accounts, email lists and other marketing channels.
This includes responsibility for:
All content published through their channels.
Obtaining the necessary rights and permissions for images, videos, music, text, trademarks and other materials.
Ensuring that their promotional activities comply with applicable laws and third-party platform rules.
Providing appropriate privacy notices and obtaining required consent where personal information is collected.
Protecting personal information and preventing unauthorised disclosure.
Ensuring that their promotional materials are truthful, lawful and not misleading.
Paying their own marketing, website hosting, advertising and other operating expenses.
Affiliates must not collect customer payment information or confidential customer data on behalf of SportsApp unless expressly authorised in writing.
13. Legal and regulatory compliance
Affiliates must comply with all applicable laws of the Republic of South Africa and any other jurisdiction in which they conduct their promotional activities.
These may include, where applicable:
Consumer Protection Act 68 of 2008.
Electronic Communications and Transactions Act 25 of 2002.
Protection of Personal Information Act 4 of 2013 (POPIA).
Applicable tax legislation administered by the South African Revenue Service (SARS).
Applicable advertising standards and industry codes.
Applicable copyright, trademark and intellectual property laws.
Applicable laws governing electronic communications and unsolicited marketing.
Affiliates are responsible for determining and meeting their own tax obligations, including declaring income earned through the Programme and registering for tax where required.
SportsApp may request relevant tax or payment information where reasonably necessary to comply with legal obligations.
Nothing in this Agreement constitutes tax, accounting or legal advice.
14. Privacy and protection of personal information
SportsApp and its Affiliates must handle personal information in accordance with applicable privacy laws, including POPIA, where applicable.
Affiliates must not collect, use, share, sell or otherwise process personal information obtained through the Programme for unauthorised purposes.
Where an Affiliate collects personal information through their own website, mailing list or promotional activity, that Affiliate is responsible for complying with the legal obligations applicable to that collection and processing.
Affiliates must use appropriate security measures to protect personal information and must promptly notify SportsApp if they become aware of a data breach involving personal information obtained through the Programme.
SportsApp may process Affiliate information for Programme administration, commission tracking, payment processing, fraud prevention, compliance and related legitimate purposes, subject to applicable law and its Privacy Policy.
15. Identifying yourself as a SportsApp Affiliate
Affiliates may describe themselves as participants in the SportsApp Affiliate Programme, provided that their statements are accurate and do not mislead the public.
Affiliates must not:
Claim to be employees, directors, partners or official representatives of SportsApp.
Claim to develop, manufacture or own SportsApp products unless expressly authorised.
Suggest that SportsApp endorses their business, services, political activities, charitable activities or other interests.
Issue a press release or public announcement on behalf of SportsApp without prior written permission.
Make commitments, accept orders or enter into contracts on behalf of SportsApp.
Participation in the Programme does not grant an Affiliate authority to bind SportsApp to any agreement or obligation.
16. Intellectual property
All trademarks, logos, designs, product images, website content and other intellectual property belonging to SportsApp remain the property of their respective owners.
SportsApp grants Affiliates a limited, non-exclusive, revocable and non-transferable permission to use approved Programme materials solely to promote SportsApp products in accordance with this Agreement.
Affiliates may not modify, reproduce, sell, license or use SportsApp intellectual property outside the scope of the Programme without prior written permission.
All permission to use SportsApp intellectual property ends when the Affiliate’s participation terminates, except where SportsApp expressly permits otherwise in writing.
17. Term, suspension and termination
This Agreement begins when SportsApp approves an Affiliate’s application and continues until terminated.
Either party may terminate participation by giving written notice to the other party.
SportsApp may suspend an account or terminate participation immediately where reasonably necessary because of suspected fraud, unlawful conduct, a material breach of this Agreement, misuse of intellectual property or a serious risk to customers or the Programme.
Where appropriate and reasonably practicable, SportsApp may provide the Affiliate with notice of the issue and an opportunity to remedy a breach before termination.
On termination, the Affiliate must:
Stop promoting SportsApp through the Programme.
Remove or disable affiliate links and promotional materials as soon as reasonably practicable.
Stop using SportsApp trademarks, logos and other materials, except where further use is expressly authorised.
Cooperate with reasonable steps required to reconcile outstanding commission balances.
Termination does not remove rights or obligations that accrued before termination.
SportsApp may discontinue the Programme by providing reasonable notice where practicable. Verified commissions earned before discontinuation will be reconciled and paid in accordance with this Agreement and applicable law.
18. Independent contractor relationship
Affiliates participate as independent contractors.
Nothing in this Agreement creates an employment relationship, partnership, joint venture, agency, franchise or legal representation arrangement between SportsApp and an Affiliate.
Affiliates are not entitled to employee benefits from SportsApp and are responsible for their own business expenses and applicable tax obligations.
Affiliates may not represent that they have authority to act or contract on behalf of SportsApp.
19. Limitation of liability
To the extent permitted by applicable South African law, SportsApp will not be liable for indirect or consequential losses arising from participation in the Programme, including loss of anticipated profits, business opportunities or data, except where such liability cannot lawfully be excluded.
SportsApp does not guarantee uninterrupted access to the Programme, error-free tracking, uninterrupted website availability or any particular level of affiliate earnings.
Nothing in this Agreement excludes or limits liability for fraud, wilful misconduct, gross negligence where liability cannot lawfully be excluded, or any liability that applicable law does not permit the parties to exclude or limit.
Nothing in this Agreement limits any rights or remedies that an Affiliate or customer may have under mandatory applicable law.
20. Disclaimer of warranties and earnings
The Programme is provided subject to its stated terms and applicable law.
SportsApp does not guarantee that an Affiliate will generate referrals, sales, commissions or a particular level of income.
Affiliate earnings depend on factors including customer demand, marketing performance, product availability, tracking conditions and customer purchasing decisions.
Past results do not guarantee future earnings.
Any information supplied by SportsApp about the Programme is intended to describe its operation and does not constitute a guarantee of commercial success.
21. Disputes and dispute resolution
The parties will first attempt to resolve any dispute arising from this Agreement through good-faith discussions.
A party raising a dispute should provide written details of the issue and the resolution sought. The parties will make reasonable efforts to resolve the dispute within 30 calendar days after receiving the written notice, unless another period is agreed.
If the dispute cannot be resolved through discussion, either party may refer the matter to a competent South African court or another dispute-resolution process agreed to in writing by both parties.
Nothing in this clause prevents either party from seeking urgent interim relief from a competent court or exercising a statutory right or remedy.
Any dispute-resolution arrangement must comply with applicable South African law, including any mandatory consumer protection requirements that may apply.
22. Governing law and jurisdiction
This Agreement is governed by the laws of the Republic of South Africa.
Subject to applicable law, the parties submit to the jurisdiction of the competent courts of the Republic of South Africa in respect of disputes arising from this Agreement.
No provision of this Agreement is intended to deprive a party of a right or remedy that cannot lawfully be excluded under South African law.
23. Amendments
SportsApp may update these Terms and Conditions when reasonably necessary to reflect changes to the Programme, its operations, technology or applicable legal requirements.
Material changes will be communicated through the website, affiliate dashboard or email, as appropriate.
Changes will apply from the effective date stated in the notice and will not retrospectively remove commissions validly earned before the change, except for lawful corrections or adjustments under this Agreement.
If an Affiliate does not agree with a material amendment, they may terminate their participation in accordance with this Agreement.
24. Assignment
An Affiliate may not transfer or assign their rights or obligations under this Agreement without SportsApp’s prior written consent.
SportsApp may assign or transfer its rights and obligations as part of a lawful business restructuring, merger, acquisition or transfer of the relevant business, subject to applicable law.
25. General provisions
If any provision of this Agreement is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure by SportsApp to enforce a provision immediately does not constitute a waiver of its right to enforce that provision later.
This Agreement, together with any applicable Programme rules and written commission terms, constitutes the agreement between SportsApp and the Affiliate concerning participation in the Programme.
If there is a conflict between this Agreement and a mandatory provision of South African law, the mandatory legal provision will prevail.
Notices may be sent to the email address registered to the Affiliate account or to another contact address designated in writing by the relevant party.
